Komunikat PO w Gorzowie Wlkp. w sprawie VI Ds.7/15 eng

The Gorzów Wielkopolski Circuit Prosecutor, Division  II Economic Crimes, is conducting investigation into case VI Ds 7/15 concerning inter alia handling stolen computer software between the years 2002 and 2005, that is an offence under Article 291 § 1 of the Criminal Code in conjunction with Article 293 of the Criminal Code. On 3 October 2017 materials related to 18 suspects were moved to a separate proceeding – this case carries the reference number PO II Ds 34.2017.

On 23 October 2017 in case PO II Ds. 34.2017 a decision was made to discontinue the investigation with respect to offences under Article 291 § 1 of the Criminal Code in conjunction with Article 293 of the Criminal Code and 116.1 of the Law on Copy Rights and Related Rights dated 4 February 1994 under Article 17 § 1.6 of the Code of Criminal Procedure due to lapse of time of limitation. A copy of the decision and the grounds for is available at the Circuit Prosecutor Office, Gorzów Wlkp., Division II Economic Crimes.

This decision can be appealed against to be lodged with the competent court (Articles 306 § 1a, 325a, and 465 § 2 of the Code of Criminal Procedure) by:

  • parties to the proceedings;
  • state or local government agencies which notified of the offences;
  • the person who notified of an offence under Articles 228-231; 233; 235; 236; 245; 270-277; 278-294 or 296-306 of the Criminal Code, if the criminal proceedings were initiated in the follow up to that person’s notification and the very offence did violate the person’s rights.
  1. The court may uphold the decision which has been appealed against or repealed and direct the case to the prosecutor so that indicated circumstances could be clarified or indicated action be undertaken (Article 330 § 1 of the Code of Criminal Procedure).

Nonetheless, should the prosecutor find no grounds to file charges, he will again issue a decision discontinuing prosecution, and the wronged party, who has enjoyed their rights under Article 306 § 1a of the Code of Criminal Procedure (the right to lodge a claim which was given consideration by the court), may file a charge with the court within a month as of the date a copy of the decision is served on them, which is equal to notification within the meaning of the provision of Article 55 § 1 of the Code of Criminal Procedure (Articles 330 § 2 and 55 § 1 of the Code of Criminal Procedure). The charges filed should meet the conditions defined in Articles 55 § 1 and § 2 of the Code of Criminal Procedure.

Another party wronged with the same offence may before the opening of the court proceedings join the proceedings (Article 55 § 1 of the Code of Criminal Procedure).

  1. The person entitled to lodge a claim subject to Article 306 § 1a of the Code of Criminal Procedure has the right to peruse the case files (Article 306 § 1b of the Code of Criminal Procedure).
  2. Such a claim should be lodged via the prosecutor office which made the decision within seven days as of the date a copy of the decision is served. On expiry of the deadline the appeal becomes null and void  (Article 122 §§ 1 and 2, Article 460 of the Code of Criminal Procedure)

 

On 23 October 2017 a bill of indictment was filed with the Circuit Court, Gorzów Wlkp., against 5 accused persons for offences under Article 291 § 1 in conjunction with Article 293 of the Criminal Code.

Notice

If the provisions of Article 46 of the Criminal Code does not apply, the court may give consideration to the motion subject to Article 335 to redress the damage in full or in part or to satisfy the wrong done. Article 341 § 1 applies accordingly.

Such a motion may only be considered providing the prosecutor effects the change indicated and approved of by the accused.

No evidence gathering proceedings are to be carried out.

The prosecutor, the accused and the wronged party have the right to take part in proceedings. By notifying the wronged party of the proceedings he/she is also notified of the possibility of concluding the proceedings without trial and that he/she may make a statement subject to Article 54 § 1. The participation of persons named in the first sentence in the proceedings is obligatory if ordered so by the president of the court or the court itself.

Prior to giving consideration to the motion as mentioned in Article 335, the court will notify the accused of the provision of Article 447 § 5.

The court by giving consideration to the motion sentences the accused with a judgment.

If the court finds no grounds to consider the motion subject to Article 335 § 1, the motion is returned to the prosecutor. If the motion referred to in Article 335 § 2 is not considered, the case is subject to hearing on general principles, while the prosecutor within 7 days as of the date of the hearing will have to carry out the activities defined in Article 333 §§ 1 and 2 (Article 343 of the Code of Criminal Procedure).

In the event that the accused charged with the offence places a motion subject to Article 338a, the date of the hearing is communicated to the respectable parties and the accused by serving on them a copy of the motion.

The court may give consideration to the motion if the circumstances of the offence itself and the guild are doubtless while the attitude of the accused makes it probable that the objective of the proceeding will be achieved. The motion will be considered if and only when the prosecutor does not object to this. Article 343 is applied accordingly.

In the event that another motion is submitted it will be considered during the hearing (Article 343a of the Code of Criminal Procedure). The wronged party may before the court proceedings are started place a statement that he will take the position of a subsidiary prosecutor  (Article 54 § 1 of the Code of Criminal Procedure).

The wronged party as well as the prosecutor may until the court proceedings are brought to an end in the main trail lodge a motion subject to Article 46 § 1 of the Criminal Code (Article 49a of the Code of Criminal Procedure).

On 3 October 2017 materials related to 18 suspects were moved to a separate proceeding – this case carries the reference number PO II Ds 34.2017. On 23 October 2017 in case PO II Ds. 34.2017 a decision was made to discontinue the investigation in part, while as regards the remaining part of the charges they were included in the bill of indictment brought to the Circuit Court in Gorzów Wlkp.
